Win a Magnetic Locator Official 2013 Raffle
Rules:
Eligibility
The Mount Diablo Surveyors Historical Society’s (MDSHS) 2013 Magnetic Locator Raffle
is open to anyone 18 years or older at the time of entry. Eligibility is to
U.S. residents only.
Tickets
Each ticket (donation) is one entry. You may enter as often as you wish.
Tickets are $5 each or 5 for $20. Checks or money orders should be made payable
to "Mount Diablo Surveyors Historical Society" or
"M.D.S.H.S" (Sorry, we cannot accept credit cards at this time.), or
well-hidden cash (however MDSHS cannot be responsible for lost cash) along with
participants name, address and phone number may be sent to: Mount Diablo
Surveyors Historical Society, 5042 Amethyst Court, San Jose, CA 95136-2601.
Mailed entrees must be received in hand by 5:00 pm, Wednesday, March 20, 2013
at the above address. Your ticket stubs and a receipt will be returned by U.S.
mail.
Odds of winning
The odds of winning depend on the number of eligible entries received. There
will be no limit placed on the number of tickets sold. In person ticket sales
will be offered right up to the actual drawing.
Drawing
The Winner will be determined by a random drawing held on Tuesday, March 26,
2013 at or about 3:00 pm at the conclusion of the exhibitor’s booths at the
California Land Surveyors Association-Nevada Association of Land Surveyors
Joint Conference 2013 at the Silver Legacy Resort & Casino, Reno, Nevada.
Winner need not be present to win.
The Mount Diablo Surveyors Historical Society reserves the right to extend the
raffle to the conclusion of the Conference on Wednesday, March 27, 2013 at or
about 12:30 pm. Winner need not be present to win.
Notification
Winner will be notified by phone on the first business day after the conclusion
of the conference after the drawing. If the winner cannot be contacted by phone
on said day, a postcard will be sent to the Winner by U.S. mail. Winner will
have ten (10) days of date of postmark to acknowledge receipt of notice by
contacting MDSHS by phone, email or as instructed on said postcard. Return of
locator notification as undeliverable may result in disqualification and an
alternate winner may be selected. Winner may waive their right to receive
locator. Winner is solely responsible for reporting and payment of any taxes on
locator. Winner may be required to complete an affidavit of eligibility, and a
liability and publicity release (except where prohibited by law) which must be
returned within ten (10) days of date of postmark. Failure to sign and return
the affidavit or release within ten (10) days, or to comply with any term or
condition of these Official Rules, may result in a winner's disqualification,
the forfeiture of his or her interest in the locator, and the award of the
locator to an alternate winner. All participants agree to receive, via
telephone or e-mail, any notification pertaining to this raffle.
Personal information
Personal information collected in conjunction with this raffle will be used
solely for purposes of this raffle or other MDSHS use such as (but not limited
to) membership recruitment. Only official officers or authorized members of
MDSHS will have access to this information. Personal information will not be
sold, published, distributed, shared or divulged with anyone except as required
by law.
Participation
By their participation, entrants agree to be bound by these Official Raffle
Rules as solely determined by the Mount Diablo Surveyors Historical Society
(MDSHS) and its officers.
Prize
ONE (1) Schonstedt, Model# GA-52Cx (Serial # 292781) Magnetic Locator will be
awarded. No substitution of prize is allowed. Prize is non-transferable and
subject to all restrictions and availability.
Prize value
The value of the prize is $917.00 (U.S. dollars) as determined by the selling
price listed on the manufactures web site: http://www.schonstedt.com/
as of January 19, 2013. Cost of Shipping the prize to the winner, if not
present, is included with the prize at no cost to the winner. Prize will be
shipped by regular U.S. mail or other another method as determined by MDSHS.
Prize donation
The manufacturer, Schonstedt Instrument Company, donated prize to M.D.S.H.S.
for purposes of this raffle.
Prize usability/warranty
MDSHS makes no warranty concerning the use or operability of the prize other
than prize was received in new condition from the manufacturer. Warranty and
specification information (subject to change without notice) is posted on the
manufacturer’s company’s web site: www.schonstedt.com.

Limitations of Liability
By entering the raffle, participant agrees that (1) any and all disputes,
claims, and causes of action arising out of or in connection with the Raffle,
or any locator awarded, shall be resolved individually without resort to any
form of class action, and entrant waives his or her right to a jury trial for
such disputes, claims, and causes of action; (2) any claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with entering the Raffle, but in no event attorneys' fees; and (3)
under no circumstances will any entrant be permitted to obtain any award for,
and entrant hereby waives all rights to claim punitive, incidental or
consequential damages and any and all rights to have damages multiplied or
otherwise increased and any other damages, other than damages for actual
out-of-pocket expenses.
Construction
All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations of
any participant and MDSHS, shall be governed by, and construed in accordance
with the laws of the State of California, without giving effect to any choice of
law or conflict of law rules or provisions (whether of California, or any other
jurisdiction) that would cause the application of the laws of any jurisdiction
other than California. The invalidity or unenforceability of any provision of
these rules shall not affect the validity or enforceability of any other
provision. If any such provision is determined to be invalid or otherwise
unenforceable, these rules shall be construed in accordance with their terms as
if the valid or enforceable provision was not contained therein.
General Release
By entering the Raffle, participants release MDSHS, and its directors,
officers, and members from any liability whatsoever for any claims, costs,
injuries, losses or damages of any kind arising out of or in connection with
the Raffle or with the acceptance, possession or use of any locator (including,
without limitation, claims, costs, injuries, losses or damages related to
personal injuries, death, damage to, loss or destruction of property, rights of
publicity or privacy, defamation or portrayal in a false light).
Raffle Sponsor
The raffle is sponsored by The Mount Diablo Surveyors Historical Society,
whose decisions regarding the selection of winners and all other aspects of the
Raffle shall be final and binding in all respects. MDSHS will not be
responsible for typographical, printing or other inadvertent errors in these
Official Rules or in other materials relating to the Raffle. If you have any

Distribution of Proceeds
Proceeds of the raffle will be used in support of the goals of the Mount Diablo
Surveyors Historical Society to: “Collect, Preserve, and Display Artifacts
of the Land Surveying Profession”
